CANADIANS AND MEXICANS UNDER NAFTA
If the transferred French engineer in our previous example were either Canadian or Mexican, then another nonimmigrant visa option would be available under the North American Free Trade Agreement. Qualifying Canadian and Mexican professionals may work for companies in the United States, Canada, or Mexico on a temporary basis, either as a direct employee or as a management consultant. In the United States, this temporary status is the TN category. The maximum period of initial authorized stay is one year, with unlimited one-year extensions.
The schedule of professions under NAFTA includes computer science, engineering, architecture, economics, and many others. The TN application for admission may be filed directly at the United States - Canada border by Canadians entering the United States to work, and by United States citizens entering Canada to work. United States employers must first file and obtain approval of a TN petition for a Mexican citizen with an CIS regional service center before the Mexican citizen may apply for a visa stamp at the U.S. Consulate in Mexico.
