EXTRAORDINARY ABILITY

Some employers could consider the O-1 visa for certain of their foreign workers. The O-1 is available for workers with extraordinary ability in the sciences, arts, education, business or athletics, or who have a demonstrated record of extraordinary achievement in the motion picture or television industry. The definition of "extraordinary ability" is a level of expertise indicating that the alien is one of the small percentage who have risen to the very top of their field of endeavor.

To qualify for O-1 status in the fields of science, education, business or athletics, the alien must demonstrate sustained national or international acclaim and recognition for achievements in his or her field. In order to qualify for O-1 status in the field of arts or in the motion picture or television industry, the alien must demonstrate that he or she is recognized as having extraordinary achievements in his or her field. The initial period of stay requested cannot exceed three years, though extensions of stay can be granted by the CIS.
