EMPLOYMENT-BASED IMMIGRANT PETITIONS WHICH DO NOT REQUIRE LABOR CERTIFICATION APPROVAL (SCHEDULE A ALIENS)
Over the past few years, the Department of Labor has determined that there are a few positions for which recruitment is unnecessary, either because of a chronic shortage of US workers, or because the position itself is not the type for which recruitment would be meaningful. These positions are precertified, and therefore do not require a labor certification application (or testing of the market for available US workers). These cases are called Schedule A cases.
Professionals, which qualify as Schedule A cases, are as follows:
1. Licensed Physical Therapists
2. Professional Nurses
3. Aliens with exceptional abilities in the arts and sciences
